Missouri Lieutenant Governor Peter Kinder filed a “first of its kind” lawsuit against the federal health care overhaul legislation on Wednesday. The legal challenge accuses Congress of overstepping its authority.
Lt. Governor Peter Kinder was on with Greta last night to discuss the lawsuit:
Heartland News 12 reported on this lawsuit yesterday:
Missouri Lieutenant Governor Peter Kinder filed a “first of its kind” lawsuit against federal health care overhaul legislation Wednesday.
Lieutenant Governor Kinder filed Kinder V. Geithner at the Rush H. Limbaugh Sr. United States Court House in Cape Girardeau.
The legal challenge accuses Congress of overstepping its authority.
It also claims Congress cannot force people to buy a product nor demand state officials enforce an unfunded mandate.
Kinder pledged back in March to challenge the federal law.
Initially, he planned to join 20 other states in a lawsuit filed by the Florida Attorney General. Instead, he filed this personal suit.
“We felt there needed to be a unique approach taken, vindicating the rights of ordinary Missouri citizens as applied to them in their lives” said Kinder.
He’s joined in the lawsuit by three other Missourians, one of those Julie Keathley of Dexter, MO.
She’s a plaintiff on behalf of her eight-year-old son, Mason, who suffers from Autism.
Lieutenant Governor Kinder says under the federal health care plan, Missouri would pay a penalty to the federal government for the state’s newly enacted autism insurance legislation.
“We felt there needed to be a unique approach taken, vindicating the rights of people, ordinary Missouri citizens, rank and file folks like you and me,” Kinder said. “As applied, the law says as applied to them and their lives.”
